Government of India notified Patents(2nd Amendment) Rules, 2020 on 4th November 2020. These rules clarify the official filing fee for patent filing by natural person or startup. In case an application processed by a natural person or startup or small entity is fully or partly transferred to a person other than a natural person, startup or small entity, the difference,if any, in the scale of fees between the fees charged from the natural person, startup or small entity and the fees chargeable from the person other than a natural person, startup or small entity in the same matter, shall be paid by the new applicant with the request for transfer. Government of India notified Patents(Amendment) Rules, 2020 on 19th October 2020 for clarifying provisions as to filing priority docuemnts and statement of working. Now the patentee is required to submit the statement of working of patent in India once in respect of every financial year, starting from the financial year commencing immediately after the financial year in which the patent was granted, and shall be furnished within six months from the expiry of each such financial year.” Please refer to the Patents(Amendment)Rules 2020 for detailed contents. |

Government of India notified Draft Patents(Amendment) Rules, 2019 on 31st May 2019 for inviting suggestions/comments from public within 30 days from the date on which copies of the Gazette of India, in which this notification is published, are made available to the public. These rules provides for submission of duly verified English translation of priority documents within three months from the date of inviting to file it by the Appropriate Office. It also clarifies that the non-compliance of such requirement will result into disregard of priority claim. It also provides clarification regarding filing statement of working with new format. 11/02/2021 | Legal Articles | GOI proposes 15 new Mega Food Park Projects under the Infrastructure Development Scheme The Cabinet Committee on Economic Affairs has approved setting up 15 new Mega Food Park Projects under the Infrastructure Development Scheme (in addition to 15 ongoing projects), involving a total Government grant of Rs. 787.50 Crore. The setting up of 15 new Mega Food Parks will result in creation of state of the art infrastructure in major parts of the country with efficient supply chain management from farm gate to retail outlets. The projects are expected to bring about substantial reduction of wastage, value addition, employment generation and increased income for the farmers. The Scheme will be implemented in a market driven manner commensurate with both global and national demands. Innovative supply chain management will be the key to implementation of this scheme. |
